  • Proof of delivery documentation
  • Copay collection services

3. User Accounts

Account Registration

To use certain features of our Services, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities under your account

Account Types

We offer different account types including:

  • Pharmacy Accounts: For licensed pharmacies to manage delivery orders
  • Driver Accounts: For verified delivery personnel
  • Admin Accounts: For RX Expresss staff members

4. Pharmacy Responsibilities

Pharmacies using our Services agree to:

  • Maintain all required licenses and permits
  • Ensure proper packaging of medications for delivery
  • Provide accurate delivery information
  • Comply with all applicable pharmacy laws and regulations
  • Maintain patient confidentiality in accordance with HIPAA

5. Driver Responsibilities

Drivers using our Services agree to:

  • Maintain valid driver's license and insurance
  • Pass background check requirements
  • Handle medications with care and maintain temperature requirements
  • Verify recipient identity as required
  • Collect proof of delivery (photo and/or signature)
  • Maintain confidentiality of all delivery information

6. Delivery Terms

Delivery Options

We offer various delivery options including:

  • Same-day delivery
  • Next-day delivery
  • Priority/Express delivery
  • Scheduled delivery

Delivery Requirements

Deliveries may require:

  • Photo proof of delivery
  • Recipient signature (when applicable)

All fees are subject to change with notice. Payment terms are established in separate agreements with pharmacies.

8. Prohibited Activities

You agree not to:

  • Interfere with or disrupt the Services
  • Attempt to gain unauthorized access to any systems
  • Transmit viruses or malicious code
  • Impersonate any person or entity
  • Share account credentials with unauthorized parties

9. Intellectual Property

All content, features, and functionality of our Services are owned by RX Expresss and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express permission.

10. Limitation of Liability

To the maximum extent permitted by law, RX Expresss shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the fees paid by you in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless RX Expresss, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

12. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Services will cease immediately.

13. Governing Law

These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the new Terms.
